Just pointing out that the Star Citizen homepage says:
"Star Citizen is currently in the ‘Alpha’ stage of development, being created in partnership with a passionate, knowledgeable, and always-welcoming community."

I won't make further comment about whether I believe the game is released. It seems to me that to CIG, the game is both in development or released, depending on what suits them at any moment in time (I'm looking at you, CIG legal department).

You can have both. There is no conflict with a released game that still is in development for new or improved content. No Mans Sky or Elite are exemples of it. But a release is a release, early access or not, with ongoing development or not.

All joking aside, do they need to? Its a Ltd Liability Company IIRC...
I wanted to edit that comment but left it as it was too long after I posted to fix, but the 'cut and run' wording was wrong for what I was trying to say, which was that if it did come to the company going down, I think it would happen very quickly without much warning, if any.
 
That's up to interpretation. The term 'Early Access' itself hint at getting early access to a game before its released/finished, CIG even said it on their website, its a special privilage to play their ALPHA. CIG is doing their best to not mention 'release' on their website so the definition and what it implies has be argued out in court, and most people don't want to burn their money doing that.
That's what class action suits are for ;)
 
I mentioned the poeple who plays it consistently say it's not released yet, and that's going to weigh heavily in CIG's favor.
I'm curious to know what the premise is for you to believe that. The reason why I ask is that I would imagine that if this was hashed out in court, and going along with analogy, it would be part of a greater argument that CIG was defrauding its backers/customers. If that were the case, I feel it wouldn't be too difficult to dismiss customer perceptions as part of the scheme. Though that's just me talking and none of what I'm saying is to be taken as legal advice or anything.

Yeah, but that's the thing, whose going to start it? The people invested in it don't want the project to end in a failure and loose their fortune. The people who got out don't want to waste more money on CIG.

I'm going by how rabidly Citizens defends Star Citizen on here and other places, forums, Reddit, youtube comments. They're the ones most invested and have the most to loose. Back during the Crytek lawsuit wasn't there a group who wanted to crowdfund CIG's defense? Groups like that would volunteer to testify in favor of CIG and maybe it'll come down to how many CIG have speaking for them vs how any are in the class action.

My belief is that all it would take is a law firm assessing how much they can make from the result if there's a path to litigation success. However, it wouldn't surprise me that it has already been looked at. CIG have a lot of money to pay lawyers to plug any legal holes in that regard.

I agree that it's likely that some superfans would jump to CIG's defense, but I would doubt its relevance as a counter to a group of people who claim they are victims of a scam. In fact, one could theorize that because it could be shown that these 'superfans' would stand to benefit from the purported scam that they themselves could be cast as accessories to it, especially if they have received monetary gain.
