You can't have the same lawyer for both the defense and the prosecution. How is Mueller going to partition info he might have gained from representing the targets of the prosecution previously?
I cannot see a resolution of this problem, since the Justice Department is supposed to reconcile such conflicts, but they would be recused from oversight of the Special Counsel. Sessions in particular can't intervene.
However the President could. He could dismiss the counsel on the grounds of this conflict. IMHO, that would be legally justifiable.
