General / Off-Topic TM infringment?


You can call yourself Elite all day long, however using the logo is another matter, I would say it's 100% illegal.
 
There seems to be a contradiction to what actually happens here

By making any Submission, the sender automatically grants, or warrants that the owner of such material expressly grants, Frontier the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, and distribute such material (in whole or in part) throughout the universe and/or to incorporate it in other works in any form, media or technology now known or hereafter developed, for the full term of any copyright, trademark or patent that may exist in such material for any purpose that Frontier chooses, whether internal, public, commercial, or otherwise, without any compensation, credit or notice to the sender whatsoever. The sender waives all so-called "moral rights" in all Submissions. The sender further waives the right to make any claims against Frontier relating to unsolicited submissions, including, but not limited to, unfair competition, breach of implied contract and/or breach of confidentiality.
 
I've been to that barber, when I came out my hair was all patchy and my nose had inexplicably stopped working.

Ill wait for patents lawyer to show up to explain why IP and patent protection are important. If you don't protect your TMs etc you loose the right to the exclusivity

well, the article actually explains why using "elite" in the context of haircuts is not a trademark infringement of "elite" as related to computer games. the imagotype most certainly is, so all the barber has to do if he gets a cease and desist notice is replacing it with a picture of saturn and some rocket with a trail or whatever looks spacey, and he's good to go.

and have an expensive lawyer ready, just in case. yeah, starman, we get it, the skies are full of sharks.

Do you all comments and suggestions become Frontier property once you post on forum . The T & C apparently they cant use any suggestions for game features so tell you not to post them

all our salt and tears belongs to frontier! not even the thargoids can dispute that!
(unless they have a more expensive lawyer, that is!)
 
There must be a reason why choose to pay ££ for the rights to use JP name rather produce an originally branded game like PC where they would have 'owned' everything which seemed to be the original idea of being self published but also goes though steam.

Companies spend a lot on Brand development. What gets me is when people take my ideas use them but trash them anyways.

Well, I'm not a lawyer but I don't believe they can protect the word Elite, only the logo.

Yes, however, I do not think that the image of the Phoenix can be protected

It's really the Phoenix specific to ED which can

But how know if the specific shape of a Phoenix has not already been done by another society ?

Frontier himself, is he sure that his Phoenix is unique ?

This is what I think too Patrick. However, he or she is being naughty using the logo in promoting their business so as recompense they should offer free haircuts to all Elite Commanders, FD devs and, if David or Ian Bell walk into the shop, they should get free perms. :cool:

In that event Patrick, that barber ought to let Michael have any haircut or beard trim he likes in order to prevent his shop being turned upside down. It might take a while tho...:eek:
