I believe we should look at the Crime and Punishment issue from a different perspective. For a long time we have seen topics, rants and complaints about “a player killed me!", "I've been ganked/griefed!" "those murder hobos!", etc. and how those player killers should be more punished because a simple bounty is not enough. But those people bought the game just like me and have a right to play the game the way they want just like me.
Now when we look closer to those topics we see that the main complaint is not that they were killed by a player, ganker or griefer. Is that they lost and they are punished for loosing the encounter and when they go to the forums to vent all they get is "git gud", "don't fly without a rebuy", "go to solo or private if you can't handle the challenge". And that is why they want those player killers to be more punished for that.
Other competitive multiplayer games either FPS, MMO's, Racing, Card Games, even real life competitions all run on the same premise: You win, you're rewarded; you loose, you're not rewarded. But in Elite: Dangerous we get the opposite in a PVP encounter: You loose, you're punished; you win, you're not punished.
Yes you loose unclaimed exploration data, cargo, bounty vouchers or combat bonds, but you also get slapped in the face with a rebuy screen. Is true you pay 5% of the ship value. But that 5% of ship value represent 25%, 50%, 75% of a player savings (not total assets) and that lost is significant enough to not take the risk of player encounter in open play for many of those players.
I believe with the proposed C&P system the game will become more anti-competitive. You get punished for loosing the battle, but also punished for wining it and that is too harsh.
I propose the developer to make a global event where for a couple of weeks, deactivate the rebuy screen in pvp battles and see if more people get engaged in player interactions like cooperative and competitive multiplayer, kill for the merits, kill for the fun and see how many people complain about how they got killed for no reason or how they loose their expensive ships. See how many players are more willing to experiments new ship builds, discover new Metas, organize free for all battles and tournaments etc. Then decide what system is more adequate for the game. More punishment for the winner of the battle or less punishment for the looser of the battle.
