Say my ship gets blown up by pirates, the insurance company has to buy me a new one
With my idea, the insurance company would be able to ATTEMPT to reclaim this cost from the original pirate.
So in addition to any other penalties for piracy, lets say 50% of the cost that the insurance company has paid out is reclaimable by the insurance company by any means possible.
In practice this means NPC insurance officer ships having the legal rights to interdict and extract cargo from pirates using any of the means that the pirates themselves use. Using limpets or just attacking and hoping that cargo is released.
This harassment would continue indefinetly until the debt was repaid either with assets or with a credit transfer, like what happens with bounties.
There is no metagaming way round this penalty that I can think of, it's a credible deterrent to piracy
Certain insurance groups could be active in different areas, so the only way to escape the harassment would be to move away.
