What happens if you kill a cmdr in a warzone who has not selected a faction to fight for .... A yellow hollow .....not green or red ... ? Are you immediately fined and wanted ??

If they don't have a bounty already and are "Clean" (you ll see that when you lock on and automatically start scanning them) then yes you become wanted.
