Interesting read. It looks like the Court has modified habeas corpus as a guiding principle.

I wonder how long it is before this case (or a case of a similar case) makes it to the US Supreme Court (cite Marbury v Madison)?

I agree with your comment on providing this type of data..... or not providing it as the case may be.

Why anyone would willingly provide biometrics for a commercial device is beyond me.

Because it is trendy and cool. End of this month I'll be defending my doctoral thesis on measuring emotion via physiology. Much of the physiological data people already voluntarily record with their fitness devices, which are tracked and linked to the internet. Beyond that we need stuff like fEMG, but in wont take long before we can replace that with camera surveillance. Or just sell iElectrodes and some stupid app. :p

Thank god governments consists of people, and people are idiots. But the possibilities are... interesting. :)
