(No, they are not cloaked)
So far, we have the invisible ship problem showing up in at least 2 different ways, but my assumption is that it happens even more.
1. When playing together with another player, being in the same instance, one player can see and fight the NPC, the other does not even see him and only sees player one shooting into the void. This problem seems rather prevalent, since I experienced this first hand on 3 different occasions.
2. Jumping into an instance, nothing is seen, but you get a message from nowhere. Video below.

3. (Assumption) Your ship taking damage and exploding for no apparent reason. Collision with an invisible ship?
4. (Assumption, most probably wrong, I rather think the instancing is just borked) When interdicted, the players involved spawn in empty space. Maybe they just can't see each other?
My guess? - The Flying Dutchman perhaps. Phantom Ghost ship.
