General / Off-Topic European Law says I can sell my downloads

Seems to me it's like ticket sales, as long as you aren't making a profit on it, or like $1 over. But I don't know the specifics of that law.

I'm just asking around to find out first, I know the laws are catching up with downloads and I've heard stuff here and there but nothing really concrete.
 
If you wait long enough there may be a kids version released on console, that would suit you down to the ground I think.

I'd be willing to sell my PB account too inc. Kickstarter decal etc.

I believe it depends on the terms of your purchase, if you actually bought the download then you may well be able to sell it, however most companies have far better legal teams than most of the public do so usually you don't buy the download, you buy access to something and the download is given to you to allow you to access content.

You might be allowed to sell the download, but not the access to the companies content which makes the download worthless.
 
What you could do is just sell the account. Give the buyer the password and he can then change the email address and password. Dunno about the Commander name though.

Yeah thats how it goes down most of the time. Most gaming communities have for sale sub forums etc. I flogged all my EVE accounts and ISK that way. Fascinating how just as in life digital 'commodities' are subject to inflation and speculation. I sold my EVE stuff for more than I ever spent on subscription over the years. Supercaps ftw. Guys in my old alliance were RMT'ing their mortgages towards the end.

I think a lot of companies offering digitally distributed content would prefer potential new customers to purchase new retail copies of their games instead of buying an old copy from someone else. That said, a lot of shrewder companies realize that like the use of torrents for media etc. allowing customers to buy in then cash out like a casino is better for business long term (especially if you have a DLC and/or a microtransaction based model) than punitively forbidding third party sell ons. Many people look at gaming like buying equities and imho it is the future of things ..

Officially its bannable/EULA violation to sell EVE accounts or currency yet everyone does it anyway. In practice CCP can't track every account that changes hands or logs in from a 'new' IP etc. They generally only go after people if a formal complaint is logged. A fair and sane approach. But then CCP largely practice what they preach when it comes to internet uber capitalism. :)

If it is bound to your account, it may not be possible.

AFAIK you´re also not allowed to sell your Steam Account (with all games connected to it).
Similarly AFAIK it is with F2P - MMORPGs ... you are neither allowed to sell whole MMORPG accounts, nor are you allowed to sell any things you bought with money for this account (for example expansions for LotRO).

So, if the game/pass is bound to your account and the account bound to your person, it may be not allowed to sell it, I guess
 
Unfortuantely there is no such thing as "European Law", the EU will issue directives that each member state must implement within their own legal frameworks.

When X-Rebirth came out with all the horridness that came with it and people asked for refunds Valve stated that they are based in luxenbourg and they had no requirement to issue a refund what so ever.

What they did was a goodwill gesture of a refund and a flag on your account with the promise that if you asked for a refund ever again you would have your account banned.

I am not sure where FD stand being a UK based company on digital software resales so be prepared to be let down.

And being as he paid for the finished game and has been allowed access to the Beta version (which is the development process), he hasn't actually been sold goods that can be classed as "not fit for purpose". As he is in the Beta and not the Finished Game.

So hasn't got a leg to stand on.
 
I would let my copy go for £35 if that's actually possible to do, legally I can as far as I know.

Unfortuantely there is no such thing as "European Law", the EU will issue directives that each member state must implement within their own legal frameworks.

That's true of EU Directives, but not EU Regulations which become immediately and directly enforceable as law in all EU member states. No transposition or interpretation.

No idea if that applies in this instance.

I've had 4 refunds from steam, never underestimate persistence. :)
