When X-Rebirth came out with all the horridness that came with it and people asked for refunds Valve stated that they are based in luxenbourg and they had no requirement to issue a refund what so ever.
That was just a smokescreen. The relevant law is the law of the country of purchase, not the one of the country of origin. the law usually protect the consumer well in europe, but companies make it a hurdle race to discourage people. Just appealing the TOS would take a court ruling, meaning time and money most single individuals don't have.
So it ends up like, "everybody gets away with whetever they can get away with".
 
I think the law generally needs to catch up with EULAs and digital owneship. Up till now you are sold a license for the software which you never actually own which is how stopping trading in accounts is enforced.

TOS don't override law so it would not end up in court, you can't put down in TOS i have the right to kill you.
 
This originally stems from the case UsedSoft GmbH vs.Oracle International Corp.

And later, from a case concerning the German consumer watchdog Verbraucherzentrale Bundesverband vs Valve.

The German courts have since ruled twice that Valve has the right to restrict transfers.

So in Germany at least, and as concerns Steam, its unlikely you can transfer your digital content.

Actually, the opposite is true.

AFAIR the relevant case tested the idea that someone could not resell their software as it was a license rather than a product. The court found that an inifinite license was the same as a product, and the EULA was therefore trumped by basic EU law.

However, no major retailer/store/publisher currently supports reselling digital products. Unless someone brings a case, or the EU body decides to investigate, there isn't really any right to resell a digital product.

Your right, only option left is to be a thorn in the side, it often works.
 
Yeah i remember something about a guy trying to sell his steam account thinking he is allowed because of eu law,and failed.

btw you own the right to play the games you don't own the game,that's how the company's get around the law i think.
Stupid as we should have the right to sell what we bought but we cannot always have what we want.

Btw why do you want to sell this great game in the first place. :)

But I was wondering what the record is for the most people ignoring a single user?
I've paid for a number of games in my time that were so appalling I reckon a refund was deserved. But I've never wanted a refund because a game didn't turn out to be what I expected. Because I do my research before buying a product, or I take responsibility for my error. Oh, and I read reviews. But then you can't have proper reviews before a game is released, and it would be silly to demand a refund on a product that hasn't even been released, right? ;)
 
I think if I sold it they would make the game unusable, even more than it is now.
