OK currently we have ship "Insurance" we die, no matter what the circumstance, no matter about the cause or who is at fault and for a 5% Excess/Deductible, we get a shiny new ship.
In the real world that Insurer would be out of business on the first claim.
The reason for this is nobody pays into the fund, they simply claim 95% of the value of the ship that was destroyed. I don't imagine that insurance will ever be any different no matter what time period we are playing in. Insurance is based on everyone putting into the pot and claims from the pot are hopefully less than the value of the pot thereby giving the Insurer a reason to trade as he makes a profit.
Also there is no consequence of the action that caused the loss. In real life if you get your car/boat/plane damaged or destroyed, as a result of illegal actions on your part you can try and claim but you will be declined. Insurers don't like criminal activities as it is against the public interest so they don't pay.
So my suggestion is a relatively basic change to the way Insurance is handled.
1. Insurance is bought at the same time as the ship and is paid upfront at the selling screen.
2. There would be different levels of cover offered because in this Universe illegal actions are not so frowned upon as to be excluded.
4. Excess- Basic 5% Extended 15% Super 25%
5. No insurance no payout
6. Got the wrong cover- had basic and got zapped by security with a wanted passenger, or had an outstanding bounty and die - No cover. Got extended and killed an innocent- no cover
No idea how easily this could be implemented but would make this aspect a little closer to real life.

- Basic cover- cheap and cheerful- provides replacement cost but only if you were not breaking the law when the loss occurs, nor did you have any outstanding bounties.
- Extended cover- Not so cheap- but on top of the basic cover you will be paid out if you have an outstanding bounty(except for murder) at time of loss
- Super cover- gonna need deep pockets- All in no questions asked we don't care what you did cover, we will just pay out.- A must for all who like to kill NPC or CMdrs who were not Wanted
