I end up hostile with pirate factions often. I think they're supposed to shoot at you if you go to a station they control, but I've never accidentally run into that situation. They don't treat me any different when I run into them in a HAZ RES. I don't get interdicted more often. The biggest loss not being qualified to do missions for them.
I think they should be out to kill me. Constant hit men being sent to kill me (no further loss of rep if I kill them). If they're in a boom state, send wings of engineered ships that ARE going to win the interdiction game. Maybe start with just a few ships and escalate to the death squad wings. If you get through all of them, start it again on the next server tick.
Counter balance: If I'm allied, those factions should come to my aide. Not just the police - all allied factions in the system. The response time of the police should be faster than normal; all other allies have an immediate response. They also scale based on the faction state, but not as strong as hostile factions. A hostile faction in boom might send 2 wings: 2 elite anacondas, 2 dangerous eagles and 4 master FDLs (all with very high bounties). Allies in boom might send a few ships: a deadly anaconda and a few vultures. If you leave before destroying the enemies, you lose a bit of rep with your allies.
Final counter balance: Allied status slowly decays to friendly over time.
A minor scuffle would turn to a mini conflict zone. Every system your hostile faction resides becomes a threat; especially if you don't have allies. I'm sure there would be a few other implications to such a system.
