XBOX via Horizons.....Notice recently that when the Pirate is killed, it respawns in the same instance and have to go head to head with the same pirate. bad news when your ship has taken hits and shields are half down...the respawned pirate has fresh 100% shields and hull...anyone else experienced this?

Happens occasionally. If you're seeing it all the time it is a new issue. Regarding this being bad news ... you can always run

Lol, 'new feature' would be good if you gained 2xmission payouts but you only get double bounty
Oh forgot to report when you kill the pirate first time, 'Mission Successful' doesnt appear...Mission is only successful after killing the Pirate the second time

This has happened for a while, before they use to high wake at 1% health then spring back at full health and shields, you use to be able to get around it by scanning their wake. Was bit odd but it did stop them coming back for round 2
The respawn happens sometimes before they get to 1%....i can be fighting the pirate and suddenly another ship jumps into the instance and it's named the same pirate, so now there are two pirates to kill and both bashing up your ship...my Prismatics hold out ok, but just think it's a bit of a shocker as you don't claim the mission until both are vanquished
It's a 2x bonus kill.
