General / Off-Topic Smartphonegame uses E:D Screenshots for advertisement

Don't know where i should post this but today i got a commercial from a smartphonegame that used screenshots from ED.
My question is now, is such a behavior prohibited?
Someone who didn't know ED would maybe suggest that is actual ingame footage.

In the comment section someone has written this:

His german commen translated:
"The advertisement shows totally different gameplay. Just another run of the mine game. Instantly deleted it afterwards."

The support says this:

How cheap is this. >_<
The support answer is the bigger problem.
They stated this is later game content. (mostly you have to pay for)
Someone could dig into the game paying money in the hope to reach this non existent content.

I reported it to the mods for you.

But Interstellar War on Google play doesn't contain that screenshot.

Yes, exactly that.
It was a pop up ad from Walkr, another (cute) game.
There was a short video, who showed maybe the gameplay and after that it shows the ED screenshot with some overlays. But after reading the german comment, it seems the video did not show the real gameplay too. Or he meant also the screenshot.

I'm more concerned about the support answer from the developer. (Seemingly suggesting it's later game content etc)

That's the story behind that and why this happens. (Found this link after i searched for similar cases and legality.) >_<
