Yes PVP is unfair.

Ziggy, the discussion is that ED should not be controlled "by the law of jungle", because supposedly it has the strong governing structures. I beg to differ bcs the way I see it the most of ED space is uncontrolled wasteland where anything goes.
Toxic_Waster, I realize that so I'm pointing out in what areas law could and should be reinforced while acknowledging that a large part of space remains uncontrolled.

You can kill with impunity in vast stretches of the galaxy, you should face the consequences in a small but important controlled part of the galaxy.

I totally agree with this. However, if we're after "the realistic model" along with the punishment FD should increase the reward for PvP activity such as for example the ability to salvage the ship wrecks or even hijack the ship and imprison the pilot.

Reward for PvP and realistic model do not compute.

I doubt that being held hostage in the victor's hold would form engaging gameplay for the defeated pilot.... Especially if said victor passed the escape pod to a ship belonging to someone's alt account that then logged out for a few months.

Ship boarding and fighting is pencilled in already and we have been shown concept art for it. This is not PvP tho and if it happens it will (should) be available for all modes

Just an example. Hiking up penalties for the assaulting party is the very one-sided approach.

On another note holding a pilot as a hostage can create the very emerging gameplay when other pilots dispatch the rescue mission.
 
Now if there were a couple of dedicated zones for PvP? Or the game actually used its mission system to pit willing CMDRs against each other?
Or the willing CMDRs get together, arrange a regular PvP meetup.

You even could make teams and have a tournament. Or a last man standing event. Don't wait for FD to arrange emergent gameplay :)

I doubt that Frontier would facilitate players being able to deny other players the possibility of playing the game by putting them at the mercy of other players. In combat the worst that can happen, at the moment, is an escape pod to the last docked station.
 
According to your theory I'd assume the universe consists from the multiple societies that often collide with each other. It's not only the disputed territories, but also the vast uncontrolled wastelands. So most of the space would be with the social vacuum with no governing system in place. What natural laws should be applicable there?
This is nothing to do with 'natural' law. It's social law. In controlled systems there must be legal consequences for crime - depending on the controlling society, of course.

Outside of controlled space, by all means knock yourself out. Gank, slaughter and 'roleplay' anybody you like.

But currently we have a system where you can do all those things wherever you want - controlled space or not. And that, as many others have already pointed out, doesn't sit well with the lore. It would fit well with the idea of a purely PVP arena game, of course - but if that's what ED is to be then it should be clearly announced so that those like me can bail and find something else to do.

It's rather impossible to arrange meet ups when FD servers routinely struggle to lump anything greater than a single wing in the same instance.
