So does that mean they should provide you with a new estimated delivery date? Even if they just keep changing it? There doesn't seem to be much of an ETA for Star Citizen which is my biggest issue with the project right now as a backer. I don't even feel confident that I know what decade it's likely to arrive in.
I guess I still feel that if you give a company backer funding then you aren't likely to see that money again and some of the risk should be on you. However, if the general consensus is that backing on Kickstarter (or supporting a company with a pledge through their website) does include promised rewards and they aren't able to provide you with those in a reasonable estimated amount of time it does set a bad precedence. Can companies just promise the earth and not be liable as long as it looks like they are doing something for the rest of the time the company exists? I don't know. I'm still excited for SC (SQ42 in particular) but I'm now leaning towards the opinion that it wasn't a suitable crowd funding proposal, but I do believe Roberts has good intentions.
Some people see Kickstarter as some kind of gift/donation yet kickstarter themselves don't seem to see it that way.
I bought in just after not through any tactical reason but simply because I'd never heard of CIG or Kickstarter during the Kickstarter phase.
For me it's really simple. I gave them money on the understanding they would deliver the thing that was promised to me at more or less the time it was promised.
That hasn't happened - I can't see anyway the onus for that is on me and regardless of T&Cs it seem abundantly clear who hasn't kept their end of the bargain.

ETA - and yes - with their weasel terms in their T&Cs they can just re-write them whenever they like and absolve themselves of any obligation to tell you anything or deliver anything except when it suits them. And some people seem to think that's absolutely fine (not a dig at you as you don't seem to think that way).

QuiteBut they're at least getting 'two bites at the cherry' for one day's work. Which is perhaps just a bit more damning than if they had just one office in the same country.
Since you seem to be from EU timezone.. just get yourself a chargeback. Contact your bank, explain the situation (100 million dollar business took your cash and doesn't deliver), show them the email saying they will not refund you, get your cash back.
EU has great consumer protection laws.
That would be hard to proof, since cig already deliver something (Even if people here hardly tried to negate this).
