Plus you need to factor in the negative effect on whichever studio is experiencing the micromanagement technique at any given time.
 
Just sent a response with quotes from their own TOS and proof from Kickstarter that they failed to deliver the relevant pledge items.

So there you go guys, forget about refunds because the delivery date is subject to change, as per their ToS.
Which means, they're allowed to never release this "game" and you can't do anything about it.

So does that mean they should provide you with a new estimated delivery date? Even if they just keep changing it? There doesn't seem to be much of an ETA for Star Citizen which is my biggest issue with the project right now as a backer. I don't even feel confident that I know what decade it's likely to arrive in.

I guess I still feel that if you give a company backer funding then you aren't likely to see that money again and some of the risk should be on you. However, if the general consensus is that backing on Kickstarter (or supporting a company with a pledge through their website) does include promised rewards and they aren't able to provide you with those in a reasonable estimated amount of time it does set a bad precedence. Can companies just promise the earth and not be liable as long as it looks like they are doing something for the rest of the time the company exists? I don't know. I'm still excited for SC (SQ42 in particular) but I'm now leaning towards the opinion that it wasn't a suitable crowd funding proposal, but I do believe Roberts has good intentions.

I bought in just after not through any tactical reason but simply because I'd never heard of CIG or Kickstarter during the Kickstarter phase.

For me it's really simple. I gave them money on the understanding they would deliver the thing that was promised to me at more or less the time it was promised.

That hasn't happened - I can't see anyway the onus for that is on me and regardless of T&Cs it seem abundantly clear who hasn't kept their end of the bargain.

ETA - and yes - with their weasel terms in their T&Cs they can just re-write them whenever they like and absolve themselves of any obligation to tell you anything or deliver anything except when it suits them. And some people seem to think that's absolutely fine (not a dig at you as you don't seem to think that way).

You're still gonna get what you paid for, it's just taking longer. So no need to even worry about it
 
Has there been any official word from CiG on this (beyond Neo's personal response)?

Or are they sticking to the position of "We don't need to say anything because we are within our rights and we have your money..."

The way things are going that seems far from certain and you really don't get to decide what I think is a reasonable time frame given the date that was estimated when I bought in.

So do you think they will? Because that implies that they need to provide some form of "delivery date" even if they keep re-writing it, and currently they no longer seem to want to publicise a release date because having a dead-line is too stressful for them.

Honestly CIG, (they) need to stop selling ships! By all means, if (they) believe the "Alpha" stands up on it's own merits charge people for accounts and let people buy multiple access if they want to "donate". The ship selling annoys me, it plays into addictions and it is P2W no matter how (they) frame it. This game now has one of the largest budgets ever and as it approaches being the most expensive game ever developed that's a title you don't wan't hanging over you if your cash was raised by members of the public. It's going to attract more and more media attention and scrutinisation and YES high profile criticism and no amount of labeling it as "poor little noble poppies" will be enough. It's a games company selling virtual assets for years to invest in a great sounding concept, that isn't noble - they aren't curing cancer or something.

Since you seem to be from EU timezone.. just get yourself a chargeback. Contact your bank, explain the situation (100 million dollar business took your cash and doesn't deliver), show them the email saying they will not refund you, get your cash back.

EU has great consumer protection laws.

True enough. My experience of a decade working for a truly global brand is that there are levels of kafka-esque lunacy only possible when you are at the mercy of a different office and time zone being able to provide you with key data / continuity.

It can occasionally result in your entire day being reduced to waiting around repeatedly messaging the other sites in increasing desperation; only to finally be informed that your contact is OoO and nobody can cover their desk!

That would be hard to proof, since cig already deliver something (Even if people here hardly tried to negate this).
 
And some people wonder why is it that much bad mouthing about the CIG?Just wait the best play in this"Circus"is just about to happened soon.....
