Weirdly, Mr Smart has called Massively OP shills for CIG in the past. I've always thought their reporting reasonably balanced, given they make it clear they are stating their personal opinions. Sometimes favourable, sometimes not.

They do seem to report on SC stuff without fail while being a bit more reserved about other space games, SC and its drama must have considerably higher page/ad views.

Ain't that painful truth?

I mean all this awesome tech...and it is brought down because flight model and actual combat is just...not there. It is not fun.

ED space combat? Fun. WC space combat? Lots of fun. SC/SQ42 in fifth year of development and they can't show one minute of good, awesome space combat gameplay.

9) General comments: -too much space trash in orbit of that planet -lighting in hangar is missing, thus too dark -they have more than 32768 animations in the game (stock Cryengine limit) -more than 100 scanned heads -you can interact with most crew members -Point of interest system for AI to interact with player and environment (i.e. reacting to player looking at sth, etc) -was getting caught part of his plan?
Overall I have a very good impression. They know what they are doing well and they know what they need to improve. It is really authentic and I trust them to make a great game :)

Clashes SO heavily. They basically admit they have NO AI, no AI SYSTEM TO WORK WITH, and it is GOOD IMPRESSION?

And this long walking is IN THE MIDDLE OF THE GAME?

And they don't know what gameplay will be but they do other stuff first? Whut?!

5.Termination. Reading that, they literally want to be a law unto themselves... breathtakingly presumptuous.

Its worth keeping in mind that you cannot sign away rights that are otherwise covered by the law in most countries. CIG might want to keep that in mind as well.

Judging by how they decided publicly respond to CryTek court case I will go with assumption that understanding legalese and how it works in practice is not their strongest suit. It smells more of 'might is right' approach.

I would put it a slightly different way. But first let's break their sentence apart...

"you agree that Company shall be entitled, without bond, other security or proof of damages, to appropriate equitable remedies with respect to breaches of this Agreement, in addition to such other remedies as Company may otherwise have under applicable laws."

Now the second part (non-bolded part) of the sentence is what every company or individual has a right to. The first (bolded) part is totally unenforceable, despite CIG's most deepest desires to become "the law".

I particularly liked their cute addition of requiring no proof of damages. Priceless. [haha]

These agreements are meant to be understandable by the end user, and should be clear and easily understood (they never are). The above gives me the impression that if the program doesn't contain everything they have said will be in the game you can't do anything about it? Is this a normal thing in an eula, as it appears to be an exemption to themselves for false marketing.
 
Completely OT - sorry mods - but along the same lines, if you "buy" a mainframe and don't keep to the license, you absolutely agree to having a mainframe shaped hole cut in your building when they extract it and pay for any repairs yourself, as well as paying for the cost of them making the hole in the first place :D
