Though the court ultimately sent me to arbitration, nobody had previously made them state on the public record, let alone defend, their positions. Though I did not enjoy getting my handed to me yesterday, the transcript of the experience may prove more useful than the experience itself, especially in the hands of better attorneys. They are now on the court record as saying they believe moneys pledged are in fact donations, in their words "like when you give money to build a church"... They are on record now arguing that the value proposition is that you've already gotten what you paid for, because you've "played" (their words, not mine), the "many game modules" they've released... They are on record arguing for the application of Terms of Service to transactions occurring before those terms existed.
