You make a fairly interesting case. I don't know the intricacies of international contract law, but I can imagine that a reasonable interpretation of 'exclusive access' in this industry would mean 'to the exclusion of the general public', with the exception of influencers and perhaps some other groups such as family members. Alternatively, developers can easily circumvent this by offering those groups a different version with a different name. I would be interested to see some actual case law dealing with this sort of problem.

To be honest, I'm not sure there has ever been legal action taken for an issue such as this. Due to a low award that could potentially be had (at most the cost of the game - in this case) from a case such as this suggests that pursuing legal action would be much more costly than any award even if a case is won. It would take a class-action suit to make a case such as this even remotely worth pursing. I would tend to believe that Frontier and their team of attorneys already know this.

What I'd like to see from Frontier is simply a public apology for creating the confusion and a promise of withholding words or phrases that are seemingly misleading in future game releases. I purchased the Deluxe Edition in large part because of the alleged exclusive beta access and to a smaller degree because of the 3 animals that are supposed to be limited to the Deluxe Edition. We'll see in the future if Frontier sells those 3 animals within a dlc or adds them to the base game. Which would be another breach of contract if they do. As for now I have every intention on playing and enjoying the game. However, I might refrain from purchasing games in the future where sales promises might easily be broken or seem misleading.

Phew... we are still zalking about a game, are we? Seriously, why I agree that the communication of the beta lacks a lot and things could have gone better with communication, talking about law and law suit, public apology and whatever are a bit over the top for me.
Am I annoyed about the "summer" when purchasing the beta that suddenly vanished and isn't spoken of? Yes.
Do I feel tricked? Maybe. Depends on how long it will take after the beta will be released after gamescom.
Do it hurts me or (in my opinion) the contract, that influencers get to play the game for a few hours a few days at gamescom? Heck, no. It's advertising. Advertising means more people who buy the game, which means more budget for DLCs and support of the game.

I still think it's a bit weird that the normal public gets to play the game early at gamescom while I sit at home waiting for info as to when I get the access I paid for, though. But again, as long as we are talking one or two days after gamescom as the day for the beta release, I'm calm. If we talk more than a week we can still begin to roar.

Last but not least: I look forward bathing in the hype of the life streams. I enjoy lets plays and am even happy to see good lets players play the game before I get my hands on it.

I’d like to point out what Bo said earlier in the thread, because I feel like some people may be a bit confused on what people going to Gamescom will be playing.

Other than content creators, I can pretty confidently say that people going to Gamescom aren’t going to be playing the game at it’s complete capacity, as many game demos either are timed or only allowing access to certain features.

Plus, on the steam forums, the mod Harbinger has stated that most likely, the build will be an alpha build.

Take it however you will.

I should add that my interest in this was purely academic, being a law grad myself; I neither expect nor want a public apology or anything else from Frontier, I just want them to focus on developing the game.
