Can factions take over systems with prison ships in them?

No, they can't.

Just be aware: there are "prison colony" governments (which can be invaded and taken over). These are different from "prison" governments, which are BGS-protected and so cannot be invaded or overthrown. When you commit crimes, you only ever get sent to the second ones.

Surely it's when you get caught for the crime, not the commission of it.
