I have been wondering if one has to sell exobiology data to get "first to discover", or do the servers log one as "first to discover" after the three diversity samples have been scanned.

I didn't actually realise this either, I thought the Biologicals tab in the system map would show the species and the commander who first discovered it there.The First Discovered credit bonus only applies when the data is sold, but first to discover a Codex entry in a region is registered in the Codex immediately after the first sample.. The only "tag" for exobiology is in the Codex.
So, similar to discovery (after the data is sold) and first footfall (immediate). Especially the Codex Companion app as it keeps track of all of your discoveries in a displayable format.
Vista Genomics gives you a bonus if you are the first person to hand in a sample from that planet. There is no "first discovered" tag as it were for exobiology. As you and others have said the entries into the Codex for first reported in a region are really the only "first discovered" there is. All you get from Vista Genomics is double the sale price.Thanks for your reply's guys.

Oh i see. Thank you very much! o7As Ozric said above, the only "First to Discover" for Exobiology is the credit bonus at Vista, and that is on a per planet basis.
As far as the Codex goes, there are two entries per thing, per region. There is Reported, and there is Confirmed. Reported gets filled in when any commander is the very first to discover a specific thing in a region. Reported is displayed for all commanders in the game. Confirmed gets filled in when the individual commander personally discovers something for the first time that has already been discovered by another commander. For example...
Lets pretend that you are out in The Veils region. You happen upon a planet with 6 bio signs. You go down and scan them, and one of them was Osseus Discus Purple (not a real variant). You were the very first commander to ever discover this variant in The Veils. Your name would show up under that variant as Reported in the Codex for all commanders to see. Now one of the other plants was Stratum Paleas Yellow. Something you hade never seen before, but other commanders had seen loads. In your Codex, this would show up under that variant as Confirmed, and would only show that for you personally.
Basically for the Codex, Reported is for everyone to see, Confirmed is personal to the individual commander.
