Hardware & Technical Goodbye, cruel world..

Apparently, my GPU decided to take that to heart because last night my EVGA GTX 970 went belly up. Rolled over and died. Poof. Gone.

After some checking, it seems that the card had somehow got some surge/electrical damage in the VRM section.

The real kicker?
It's only 38 days old.
 
Ouch! Don't suppose that can be put down to a fault for RMA. I feel for you.
The company I bought it from said that their supplier wouldn't cover it under warranty; so they contacted EVGA directly and I'm now waiting to find out if they'll replace it, or if I can flush just over 300GBP down the drain.

I'm in South Africa and as far as I know, I may be covered by the Consumer Protection Act.
Did some quick research and it states the following:

In terms of s56 (read with s55) of the CPA, all goods sold to a consumer are sold with an implied warranty of quality, that cannot be contracted out of or revoked. The warranty gives the consumer the right to receive goods that:

  • are reasonably suitable for the purpose that they are intended to be used for,
  • are of good quality, free of defects and in good working order, and
  • will be durable and usable for a reasonable period of time.


If goods are found not to comply with these requirements then;
  • up to 6 months after receiving the goods;
  • the consumer can return the goods, or
  • get the goods replaced, or
  • get the goods repaired.
  • The consumer can do any of these things without penalty; and
  • at the suppliers cost.

The problem is a lot of companies try to get out of replacing by claiming "user negligence." I don't want to pull the CPA on this company because I like them a lot; but if they try to pull something like that, I'll contact my lawyer for assistance.
 
I only recently got an EVGA 970 SC ACX2.0 myself... I did note when I opened it, printed inside the box it clearly said to contact EVGA directly for warranty. Part of my choice was that EVGA have a good warranty reputation although I haven't had need for it myself.

I also noted that the continents available are the Americas, Europe and Asia; and I'm at the bum end of Africa, lol. Sending it off to EVGA would take a while, and would cost me money. Going back to the company I bought it from, places all that responsibility in their hands. :D
 
i really feel for you as my gaming pc went down with m/board ram and 1 of my graphics cards and the psu all at the same time just waiting to order bit
 
Point out the entire Elite now knows about it and it would be boycotted. I had a similar situation with a brand new card from the start. They tried to offer me a reconditioned replacement but I got a brand new replacement

Well I've been using my 760 the entire time and it's working great.
But...
Dual-channeling my RAM ... now prevents my PC from booting. Not dual-channeling, and it works 100%.
I'm not sure what could be the issue; but I'm hesitant to stick a new card in here until I figure it out.
