Actually both are relevant - relevant to the player as it affects their decision to report incidents, relevant to FD as they have to assess the validity of the complaint.And by subjective, that means subjective to Frontier, not the player. In the end, our subjective definition means diddly squat. No one reads the Terms of Use, so I guess that is a large part of the issue.
As for the EULA/TOS - if anyone does not read it and gets legitimately accused then they only have themselves to blame. If anyone comes into the forums and complains without reading the EULA/TOS then they may forfeit their right to have their complaint judged fairly. If anyone has a legitimate complaint about how another player acts towards them by ANY means then they should use the in-game tools meant for reporting such incidents - not come into the forums and moan about it, that is only likely to garner ridicule and insults from certain quadrants of the community.
