Oh come on it's not even a competition.

I'm willing to concede that a disc-shaped item with a chocolate-covered top, that comes in a cylindrical stack, and is served with the rest of the biscuits, is a cake, if you could PM a link to your Mosquito Discord. I hope to be around tonight to join in the fun, although I would just be in my stock Sidewinder.
It may be true that they are legally classified as cakes. But the law is an Asp.

Having been diagnosed with coeliac disease five years ago, I have to eat "specially crafted gluten free" biscuits. They cost five times as much and have a fifth of the taste of a proper biccy you can dunk into your tea (coffee lovers - meh, off back to Europe/America).
The biscuit I miss the most is the plain old McVitie's Digestive. No chocolate or any other fanciness, just a plain old digestive. Dunking for Heaven!

Indeed. The rough rule is - a cake goes hard when stale, a biscuit goes soft. See VAT Tribunal case LON/91/0160 (United Biscuits).
