FD could design a special mode, similar to Open but enforcing a strict No Murder policy (think of Moebius PG or about Fleetcom PG)
Let's Call it Open-PvE
Whoever joins in Open-PvE can see other players joining the same mode (Like Open)
So we would have on the Starting Screen the following modes: Open, Private Group, Solo, Open-PvE
First murder committed in Open-PvE means the murderer gets a warning and a 48h ban from that mode (automated) - the murderer can still join Open/PG/Solo as usually, but not Open-PvE
Second murder committed in Open-PvE means the murderer gets another warning and a full week ban (automated)
Third murder committed in Open-PvE and the account is forever banned from Open-PvE (automated)
Each instance involving a murder and temporary bans can be appealed through the support - which could delete the murder from the account if it is deemed that the murder was tagged by mistake (for example someone getting out of supercruise in front of my boosting Cutter and their ship gets exploded - i will get the murder penalty, but i can appeal so FD support can investigate and delete the murder strike from my account)
It may sound complicated, but it's quite similar to what happens in the starter systems.
Murderers get the boot out of the starter systems and their permit is revoked.
