A good is faulty when it is not fit for it's intended purpose.
A game is meant to be played. If the game cannot be played, there is a fault. Now unless it's a CD issue (which is rarely the case in PC gaming), you can't "replace" it. So the seller has an obligation to either fix the fault or refund the purchase.
