And I feel like this is the way it should be. There's gotta be some level of difficulty with the smuggle missions. If it's just about racing into the mailslot, it would be "too" easy credits. Getting stopped on the way there adds that difficulty in a way that isn't too different from that mailslot-scan-experience. Sure, sometimes you'll run into a pirate or some NPC trying to stop you that isn't a cop, but dodging scans is part of smuggling. There's nothing "not fair" about it. High risk/difficulty yields high rewards.
 
I always figured they know about your smuggling as the cops have some kind of undercover agent working for that faction or the faction has a rat.

With regards to challenge, I think that when you accept the mission, like any trade you pay for the items and you can only accept a mission if you can afford the cargo. If you get scanned, you should be required to dump the goods or come under attack. If you run for it, the goods are considered tainted and Will be taken at a reduced price. Because you did not make the delivery covertly, they keep the money that you put down for the goods.

So effectively you buy the goods to be smuggled and if successful get the sweet cream on top. If scanned, you can only make back on the reduced price of tainted goods.
