You do know that it's common practice to swing the banhammer in waves? I don't know ANY company that bans on an individual basis.
And how are they supposed to do that?
These people are using the core principle of EDs data-distribution to alter the game.
There is no way of fixing it.

I think the banhammer may be swung after the first round of expansions have been sold. At the moment most publicly available reports indicate the vast bulk of cheating is happening in solo. The lack of video evidence of systematic cheating indicates it is only affecting a very small number of players. If it becomes prevalent then the banhammer will be swung sooner.
The problem is that it's also common practice to ignore cheats entirely. And although we'd all hope that they would carry out bans for cheating I haven't heard of this happening.

Trouble is we aren't clear on what is a cheat or exploit. The obvious item at the moment is the shield regeneration 'tactic', where FD have stated that it's a placeholder due to shields not regenerating in SC and they want to change it. That doesn't make it clear that FD consider abusing it a cheat. There needs to be some communication in this area as it's bubbling up and threatens to overshadow 1.3.
that's the result of poor design decision, they were made aware from the start on how easy it is to hack games based on P2P, they still choose it anyway.

Perception matters more than absolute numbers. They also need to balance your point regarding sales against how many might not purchase the expansions (or even the base game) because of the perception that they are doing nothing.

It doesn't change the fact, that there is no way of fixing it.
I think you will not get banned for using the shield exploit, this is too much FDEVs fault. They will likely just fix it and the worst (if anything) what is going to happen is that you start the game on your insurance screen.
Common sense should really apply here. Shields magically regenerating due to a transition in game mode is clearly not intended behaviour. Using it as a tactic to gain an advantage is an exploit, albeit one that would be hard for Frontier to detect. The same goes for magical transportation to your wingman's position: not consistent within the context of the game's universe, so that would also be considered an exploit. I'm really not convinced that these particular cases require a statement from Frontier to clarify them.
The so called banhammer would only be effective if it scares people off, as the root of the issue cannot be fixed.
Now from what I 've read, those hacks are not detectable, as they seem to only alter the client.
So how do you swing a banhammer, if you cannot detect these hackers?
It is the same problem that another game I'm playing right now is having...Clash of Clans, with a rising number of botters.
They solely rely on videos, sent by players because there is no other way to actually prove any EULA violation.
