Isn't having cake and eating cake the same? If you have cake and don't eat it, it's basically your own fault for not executing the according manouvers to eat it.

But they don't have anything to lose. Their money is gone. They have a crappy product. Wait, you're right, they have their heathen idol and the cult worship to lose....
I'm going by how rabidly Citizens defends Star Citizen on here and other places, forums, Reddit, youtube comments. They're the ones most invested and have the most to loose. Back during the Crytek lawsuit wasn't there a group who wanted to crowdfund CIG's defense? Groups like that would volunteer to testify in favor of CIG and maybe it'll come down to how many CIG have speaking for them vs how any are in the class action.
Indeed. It is decadent luxury. Cheese cake is all you ever need and the only excess I tolerate is cherries and berries inside them. You clearly don't understand cake development.
Valid point there. Whose going to take the step to start that class action though? The only ones that could claim fraud are the ones who still has money in the game and they are the hardcore Citizens.I agree that it's likely that some superfans would jump to CIG's defense, but I would doubt its relevance as a counter to a group of people who claim they are victims of a scam. In fact, one could theorize that because it could be shown that these 'superfans' would stand to benefit from the purported scam that they themselves could be cast as accessories to it, especially if they have received monetary gain.
From all the Citizen's comments, Star Citizen means a lot to them, they don't want to loose that. Their money might be gone, but their hope and dreams is still there as long as CIG is still developing Star Citizen. Hell, telling them their money is already spent might even make them entrnch even deeper in the hope of getting the game. But they don't have anything to lose. Their money is gone. They have a crappy product. Wait, you're right, they have their heathen idol and the cult worship to lose.

EDIT:
Some minor points of note:
- The Core Engine team progressed with the development of StarBuild, the new in-house code-build system that will replace WAF [?]
- The Core Technology team improved Building Blocks’ runtime performance, as the recent addition of new UI assets led to an increase in size and complexity.
- The Entity System team primarily supported various technical initiatives, including RaStar and the Resource Network. This involved exploring ways to create and limit generated locations to provide a rich experience without negatively impacting performance.
Last month, AI Content made a strategic decision to concentrate resources on a single location, which brought several benefits; one being a more iterative review process, as they now meet daily with leadership and receive detailed feedback, allowing them to raise the quality bar to a shippable level.
They also progressed with the hangar and mess hall locations. In the hangar, they introduced an overseer behavior that underpins supervisors for the deck crew, ordinance officers, and fuelers. These supervisors dynamically interact with their colleagues using datapads and oversee their work, similar to a ‘middle manager’ role.
Last month, the Animation team moved from alpha to beta work. This involved improving the visual results of reloads and takedowns as well as basic idles for weapons and knives.
I don't know what the conditions would be and whether receiving a partial refund or selling on the gray market would invalidate a claim. I think there are plenty of those who haven't received a refund though, it would have to be discussed with an appropriate attorney if one were inclined to do so, they usually have a free consultation, at least in the US, where I would imagine a case would be brought, if there was one to bring.Valid point there. Whose going to take the step to start that class action though? The only ones that could claim fraud are the ones who still has money in the game and they are the hardcore Citizens.
So the PU report told us about exciting techs which were struggling to scale...
The SQ42 report is much more upbeat...
Translation: Chris just added another quarter of reworks to that location...
Translation: Chris is now in the game...
And in other news:
Chapters are being closed out, hover mode v3 ('control surfaces') is up and running, as well as physical damage. Sim Pits are on the way. And the new MFD rework is a new MFD rework.
The ATC controller means some scenes are in a finished state. And they're doing new mocap.
Work continues on save and checkpoints!
Fire propagation progress is very encouraging...
And best of all:
That mess hall scene has to rival The Last Supper by da Vinci by now.
At least they are admitting that they're mostly working on a mess. (or is that an old joke by now?)That mess hall scene has to rival The Last Supper by da Vinci by now.

Dont try to make any sense out of that, not worth it. Alpha, beta etc mean whatever the person that uses the term wants it to mean. Who knows what the guy who wrote/approved that had in mind? In other words, this is useless information.Does beg the question - how can one team go to Beta? So animation team has got all it's animations in - but what happens when the Mess Hall team demand they add new spork animations? Back to Alpha next month?
You're starting to get game development.Back to Alpha next month?
What would you like it to be and are you prepared to pay 50$ for it?Hold on, is spork spoon-fork or space-fork?
Thing is, CI-G seem awfully keen on making video this and video that, talking a whole lot of waffle, and separating customers from their cash on the assumed presumption that any product development has actually taken place as a direct result of that waffle.Meshing Together - Part 2 seems to have gone to the same place as Squadron 42: The Briefing Room - Episode 2.
