He believes he cannot have that in open, and I feel he is partly correct because he would need FD to implement and enforce the rules he feels would bring this about, BUT.. if he were to create a group, he can create and enforce the rules that he feels would give him this. And with work can create a community around it. Those who want to play will be able to. It would require effort, but it is much more reasonable than trying and advocating over and over for FD to change the game.
It's just easier to say 'FDev fix the justice system'. Unfortunately, the game is meant to allow evil and/or immoral (read meaningful) PvP interactions...which means the justice system has to be punitive..but not restrictive. Hard balance to walk there...they are probably at the edge of it now. If you make punishment restrictive, you remove the main reasons for evil/immoral characters to engage in PvP pew pew.
If this is the goal..just make this a full on PvE only game...no friendly fire between PC's. Easy peasy. With the addition of Arena mode...this could actually occur! And everyone is happy and Kumbaya! Yeah...didn't think so. <sarcasm font off>
As to your point of 'make a group'. The group with the ruleset provided would basically implode with the first removal due to infractions...who decides who broke the rules. Who wants to deal with the blowback from a controversial call? And in this group....every call would be controversial.
The one who make the group makes and enforces the law. And why would it implode? People have been removed from Mobius.. it is still there and growing.

As far as I'm concerned, as it stands now, networking issues cause more problems for the "open crowd" than any perceived unfairness in regards to the topic of this debate. Once this is deemed in an acceptable state, the feasibility of an open only server becomes far more realistic imo.

All this stuff is about forcing people into open right? Well if that's the goal then all you have to do is make safe zones where everyone can operate with relative freedom and then the rest is the badlands. PP obviously overrides faction safe zones and makes people who are engaged in that as open targets to said faction aggressors. With an expansion of the PP idea there would be no reason to have group solo open options. Well apart from the shocking net code which destroys all reason for playing in open anyway.

If they every made high sec systems actually secure it would help perhaps attract more people into open. As it is.... high sec just means the cops might turn up in numbers about 5 minutes after the target is dead.... and by numbers i mean 1 viper and 2 sidewinders which any decent PvPer can kill without breaking into a sweat.
Now, if SJAs little minions get their final touch of improvements, and system authority turns up within second in a fleet of Vultures and FdLs, that would be something to make such systems safer (only for the highest security of course, poorer or less secure systems can be less).
Of course, that's only to encourage people to try open. Still don't see it as a reason for splitting modes or anything.
Whatever is needed for balance I'm guessing. like everything else in life there is a need for controlled balance to achieve a semblance of fairness. How about , off the top of my head , Core systems are "safe" , by safe I mean nasty punishment for taking out fellow gamers. The rest is open season.
