Define "fail". If you want to argue that SC may - at some undefined point in the future - evolve to be a fun game of some sort, sure. That might happen. It seems unlikely given CIGs emphasis on creating a life simulator rather than a game, but I'll accept some people would find that fun. At least some of the time. IMO, it seems the most likely outcome so far. Star Citizen will release, and it may even be fun.
If you want to argue that CIG can deliver the game that was promised? Sorry. That boat has already sailed - that game is dead. Not because DS says so...but because it is. There are too many flaws. Too many bad decisions. Too much that has gone wrong. CIG will need to scrap what they have and restart to fix the issues that exist now. If they can't do that, they can just paper over the cracks... and, from what I can see, they are doing what I'd expect. Pull back on the vision, shore up the engine as best they can and try to hide the shortcomings using the standard smoke and mirrors routine every game dev makes use of. I hope they will get close to the vision they have sold...but meet it? Not a chance.

DS isn't all that - true, but that doesn't make him wrong or someone to dismiss. Despite his flaws, he is very often right...just not on the timescales people want, or to the degree he himself hypes.
ED is not the second coming...it is heavily flawed in its own right. It looks beautiful, it has great sound and music, the flight model works...it gets all the basics RIGHT but delving deeper things like multicrew, some of the gameplay mechanics, the background simulator, the Thargoid storyline, Powerplay, SLFs, and a whole host of other issues and aspects of the game have (IMO) been mishandled. But - unlike SC, there is a game there and 3.x is helping address SOME (not all, but some) of the games many flaws.
And based on similar cases, the lawsuit is a real threat. CIGs decision to split the license alone is going to cause serious problems, even if the issues 2.4 are dismissed. Everything else just compound the impact.
