That is great news. Then there is absolutely no reason to fear handing out refunds to everyone that is asking for them.

Sorry, I'm not authorised to hand out refunds. But if I were, I would make you play online, accrue 10,000,000 Cr then pass your details to the man that can. :D
 
I completely disagree with this. You bought a package which included the full game. As the game is not as described you still have rights. Look again at the picture you posted where you labeled the game as a goodie pack. Where does it say buy the beta an get the full game free as an added bonus? It doesn't. It says upon release you also get the full game. Surely that's a package deal. For them to say 'no the game is a free extra' is far from good enough.

Let me pull up my misspelled example again:

You bought Beta-access to all stages of the beta. You didn't buy the game; the game is in a goodiebag that you get at the end of beta as a thank you for participating in the beta. Several times now I have stated that I hesitated to buy the beta when reading this, doubting if it wouldn't be better to pre-order.
But I'm (thankfully) not hospitalized at the moment (I suffer from an untreatable and rare nervous-system disease, which amongst other things is the cause for my disability.), and decided to buy in to the beta seeing as the game was almost going gold and I was sufficiently satisfied that the offline would happen.
Hindsight being 20/20, I should've gone with the pre-order, but what can you do...

Is it a technical loophole? Maybe, I'm not a legal expert...

Don't be fooled by the wording of the email that's being sent by FD in reply to refund requests. The game hasn't been played by anyone because it hasn't been released yet. We have only had Alpha & Beta testing phases.

Quite a convenient position for you after using their software and services, isn't it?

No it's a more of a game. Not sure if it applies here or yet, but if it goes legal you can bet the pro's will communicate in legalese while the rest of us look at them with a finger in our mouths.

I'm assuming that you've added the annotation? Without the added annotation it fails to say the full game is an added bonus. You are paying £50 for the whole package.

That is the same feeling/thought which I have right now..except that I really wait to play and think if I want an MMO or not...

Well, what stops most people is that the universe shifts in accordance with Open when they play Solo. Seeing as I'm merely wanting to make Elite doing odd-jobs around the universe without looking to get rich (merely enough to keep upgrading my Sidey and to be able to maintain it in top condition), the fact that the universe shifts I couldn't care less about; playing Solo or Open is merely a choice between two apples.
(In fact, I think that in the grand scheme of things, Solo is redundant. You might aswell interact with the people who're interacting with your universe...)

I do however understand and support the position of people who didn't want to MMO. Seeing the heritage of Elite and the fact that many people rather not have outside interferance, the ultimate lack of having agency over the entire breadth of the universe is most certainly a valid concern.
 
The final decision on what is legally in or out of the package, will be done by a judge I guess.
I can't tell in advance what a judge will decide, but chances are as you usually are a normal customer, that normal customs for sales and common sense might play a role in that decision.

It's very weasel wordy, I'm tempted to send that over to Trading standards myself regardless of the outcome of what I'm already doing. Frankly it seems FDEV have been playing very much to the letter of the law, and not the spirit of the law, in an attempt to ensure they shield themselves as much from the financial damage, and their reputation as far as they're concerned is just a casualty from all this.

No. The wording for the Beta has not changed from when I bought in, like I said, that's why I hesitated buying in to the beta.
You bought access to the beta and have gotten, as stated in the first line, access to all betastages. That's an undeniable fact. The goodiebag is nothing but a list of rewards and you should never, ever base a purchase on the fact that you get a free pack of sourpatch chewing gum. (google that one and have a good laugh. try: 'The Sims 4 sourpatch walmart' as a search.)

Err trying to pull what - and yes offline mode would be HALF the game, for some, or even ALL OF IT for many more.

Offline mode was going to allow people to play the game and progress, but ALSO BE ALLOWED TO TAKE THAT SAVE ONLINE, play some more, make credits, kills, whatever, then GO BACK TO OFFLINE MODE, and carry on.

Not 2 DIFFERENT SAVES ... in 2 different modes

HALF. 50/50 - what else do you call it?

Age of Conan did it years ago, storyline was solo offline mode, just you and whatever was part of the story no other players, you could play as long as you like, gain XP, gold, etc etc. When you fancied a change, turn that off and PRESTO! online mode again with all the muppets - you didn't even have to log out/ back in - it was almost seamless and that was hmm 4 years or so ago? It's NOT new, so why can't FDev do it now?

I neither threatened nor insulted. Reading my posts - you're doing it wrong, I said I would insult, if I wasn't concerned about being banned, and frankly it was touch and go.

Seems to me you were the one that insulted a great many posters by accusing them of trying to defraud FDev. Pretty serious accusations. Are you aware that a printed word accusation of fraud, if proven to be a false accusation is called "libel" - that carries with it a monetary fine and a possible jail term? You should be a bit more careful on the net - you're in a place of deep water and there are sharks here....

"the rest of us know what you are trying to pull" no idea what you are referring to - unless it's the bit about getting a refund because the product we paid for IS NOT the product being offered, in which case that's just our consumer rights as laid out by EU law. Nothing sinister going on there - and even FDev acknowledge they have to do this - otherwise THEY WOULD NOT OFFER IT.

Please stop posting inaccurate drivel, young people are reading this and might actually believe what you are saying is true.
