Nope. I disagree, if youre caught in Open AND in an Anarchy system, then yes fair game. But not in open and high sec system. makes no sense. If open was not the free for all it currently is, then perhaps Id use it. That's because you enjoy a challenge.Maybe because other tooled up CMDRs are much more difficult to beat as opposed to the seal clubbing that they'd much rather prefer. Who knows?
Personally, I'd much sooner fight an equal or better player as you learn nothing winning easy.

Don't take my word for it, but Ryan who has experience in this matter noticed a trend. PvEers who pool their resources and try their hand at PvP will encounter experienced PvP groups who kick their butts all over the galaxy, upon which the former PvE disintegrates.And all of this is arguing that this is the way it should be.

Does this same logic apply to those who think PvEr's are "hiding" in Private Groups and Solo then? Because you know, they're just playing within the rules?

Not really. Most of those groups tend to come from other PvP games. No matter how good individual players are, a Pickup group has a hard time competing with organized groups. And these are players who have the kind of mindset to enjoy PvP. Players who don't enjoy PvP are at an even bigger disadvantage.
Having been in attempts to control GSPs in the past, there's also the tendency of GSPies to simply log out when faced with even the hint of a fair fight. Groups wishing to fight GSPies have to remain perpetually on alert, and spread their people thin in an attempt to be everywhere. It gets old really quick.
If you want to Frontier to change things for the better, you're better off asking Frontier to add an opt-in PvP system to get the kind of gameplay you desire. That way you incentivize more players to participate in PvP, without forcing them to do so. Forcing players who don't enjoy PvP into Open to enjoy their fame does nothing but kill the game. The players who enjoy PvP are already in Open.
