Yes. Which is why several State attorneys have gone after crowd-funded companies for those exact reasons. Which is also why when contacted by the CA State officials over refunds, suddenly SC refunds were a thing. Like magic. Nobody wants the State or Fed officials all up in their business.

Well maybe you should then....also I am a backer 2 but I admit that I didn´t tried this latest version of SC/PU....anyway before was ALWAYS capped at 30 fps for the PU.....

And after reading Derek Smart claim that Chris Roberts said that 3.0 was coming in 2016, it doesn't say that at all, he clearly said that's the goal, but he isn't making any promises.
Make up your mind. Its one way or the other.
There are plenty of people on YouTube playing Star Citizen, exploring, and enjoying it.
